Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ListingHQ application and the ListingHQ Pro Setup service (together, the "Service"), provided by The Home Owners Listing Team at RESF ("ListingHQ," "we," "us," or "our"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The service

ListingHQ is an application that runs inside your GoHighLevel account and connects Ylopo, IDX, Follow Up Boss, and AI Assistantz into a unified workflow — including pre-built custom fields, a real-time activity dashboard, bi-directional Follow Up Boss sync, Ylopo webhook capture, buyer and seller automations, and AI call tracking. ListingHQ Pro Setup is an optional done-for-you configuration and onboarding service.

2. Eligibility & accounts

You must have an active GoHighLevel account and the authority to connect the third-party tools you integrate. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

3. Pricing & payment

ListingHQ Pro Setup is offered for $497 per year, billed annually, plus a one-time $99 setup fee charged at onboarding. Fees are billed through the applicable payment method or platform and, unless stated otherwise, are non-refundable except as required by law. We may change pricing prospectively; any change will not affect the current paid term.

4. Acceptable use

You agree not to: (a) use the Service in violation of any law or third-party rights; (b) send unsolicited or unlawful communications using data processed through the Service; (c) attempt to reverse engineer, disrupt, or gain unauthorized access to the Service; or (d) use the Service to store or transmit malicious code. You are responsible for complying with applicable communications and consent laws (including TCPA, CAN-SPAM, and similar) for any messaging you send.

5. Third-party services

The Service interoperates with GoHighLevel, Ylopo, IDX Addons, Follow Up Boss, and AI Assistantz. We are not responsible for those third-party services, their availability, or their terms. Your use of each is governed by its own agreement.

6. Data

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms. You retain ownership of your data; you grant us the limited rights needed to operate the Service on your behalf.

7. Service availability

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practical.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific business results from using the Service.

9. Limitation of liability

To the maximum extent permitted by law, ListingHQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the claim.

10. Termination

You may stop using the Service and uninstall ListingHQ at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk or legal exposure. Provisions that by their nature should survive termination will survive.

11. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in Broward County, Florida, unless otherwise required by applicable law.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
